Abstract :
[en] This paper was written on the occasion of a major review of the insolvency legislation in Belgium. The Insolvency Act of 1997 did not provide much details on cross-border insolvencies. The only provision aiming at cross-border insolvencies was article 3 of the Act, which in fact referred to the defunct European Insolvency Convention. In this paper, written together with Prof. Hans de Wulf (http://www.law.ugent.be/fli/staff/staff.php?staffid=20), we offered an analysis of the main principles of the European Insolvency Convention (which never entered into force, but was replaced by the European Insolvency Regulation), covering both jurisdiction, recognition of foreign judgments and issues of applicable law.
