[en] The fundamental right to housing is written in article 23 of our Constitution along with others social and economical rights since 1994. It is said to be a necessary component for the right to respect for human dignity. For the last decades, the right to housing has been quoted in many international declarations and conventions. However we still wonder: what is the real impact of this right to housing? How effective can it be? What interpretation can we give to case-law in this regard? We would like to bring some ideas and answer to the debate. Our article analyses the right to housing nowadays, as emerging out of treaties, laws and the international and national case-law.
