Abstract :
[en] This chapter gives an overview of the legal regime pertaining to choice of law clauses. The focus is on the regime applicable within the EU, in the light in particular of Article 3 of the Rome I Regulation (although reference is also made to the Belgian Code of Private International Law and various other conventions). The contribution aims to provide guidelines for contract drafters. The chapter starts with a general description of the role of choice of law clauses before analysing in depth the validity requirements for such clauses. The contribution provides numerous examples of choice of law clauses, which are commented.
