[en] This paper revisits the decision of the Belgian Supreme Court in Sebastian International Inc. v Common Market Cosmetics NV. Using the decision as starting point, comments are offered on 1°) the arbitrability of distribution disputes, 2°) which law should apply to the arbitrability of disputes and 3°) what are the practical consequences of the fact that a dispute is deemed to be inarbitrable by the courts of one country.
