This paper presents an overview of court practice in relation to Regulation 1346/2000. The focus is on cases decided by the ECJ, Belgian and French courts. Reference is also made to the most important cases decided by English courts. Cases are presented and discussed in relation to the various provisions of the Regulation to which they relate. For each case, an abstract is included, followed by (critical) comments. This overview appeared in a book presenting the main European regulations dealing with European procedural law (jurisdiction of courts, recognition and enforcement of foreign judgments). The book is part of a series founded by Prof. Georges de Leval (University of Liège) and edited by Prof. Pierre Moreau (University of Liège), which collects court practice in relation to procedural law. Blood-brain barrier (BBB) is a brain protective structure composed by endothelial cells, astrocytes and pericytes characterized by specific transport systems expressed on their surface. Moreover, the tight junctions, in the paracellular space, and the adherens junctions, in the basolateral space of the endothelial cells create a physical barrier hardly crossable from the most part of common drugs. Despite the BBB is vital for the central nervous system (CNS), it restricts drug delivery to this tissue. To overcome this obstacle many drug delivery systems (DDS) have been developed. Polymeric nanocarriers, solid lipid nanocarriers (SLN) and liposomes are developed to deliver drugs otherwise not able to pass the BBB, due to their physico-chemical characteristics. Besides their capacity to pass biological barriers, the potential advantages of nanocarriers are their capability to load a high quantity of drug with low cytotoxicity. [less ▲]

The superconducting HTS hollow cylinder has been one of the first geometries to demonstrate its utility as an efficient passive magnetic shield, and particularly for DC magnetic shielding. The shielding performances can be characterized by two parameters: (i) the shielding factor SF, defined as the ratio between the applied magnetic induction Bapp and the magnetic induction inside the shield Bin and (ii) the threshold induction Blim for which the shielding factor becomes lower than a given level. The main drawback of the hollow cylinder geometry is that the shielding is only effective in the central region of the tube and decreases towards the tube extremities because of the field penetration through the open ends. In order to improve the performances at tube extremities and hence increase the shielded volume, the tube should be closed. This can be achieved by using a superconducting vessel or by closing one or both extremities with a cap. This chapter describes the experimental and the numerical analysis of the DC shielding performances of a Bi-2223 tube closed by a superconducting Bi-2223 cap, for an axial configuration. The first part is dedicated to the experimental study of two tubes of different lengths when they are closed at one extremity or closed at both extremities. We also study the effect of the gap size between the cap and the tube. In the second part, we use numerical simulations to highlight the possible improvements and to optimize the design. In particular we study the influence of the critical current density and of the thickness of the cap. [less ▲]

La période fin de siècle s’accompagne, dans le champ littéraire français, du développement d’une série de groupuscules plus ou moins organisés et volontiers potaches. Au cœur de ces associations liées de près ou de loin à ce qu’Ernest Raynaud qualifiera de « mêlée symboliste » (1920-1922), le rire fonctionne comme un véritable ciment social, renforçant les liens des membres de la collectivité et redoublant l’exclusion de ceux qui n’en sont pas. Héritiers d’entreprises collectives comme Le Parnassiculet contemporain (1866) et l’Album zutique (composé en 1871 et tenu délibérément à l’écart des circuits de diffusion du livre), les agents engageant les projets des Hydropathes, des Hirsutes, des Jemenfoutistes ou de l’incontournable cabaret du Chat Noir se rassemblent non seulement dans une perspective dérisoire, mais encore se dotent-ils d’un discours qui, plus qu’un simple divertissement, présente cette dérision comme principe régulant l’activité collective. Ce sont, à l’aune des cas susmentionnés, quelques-uns de ces discours du rire collectif fin de siècle que nous explorons ici, en nous penchant sur les mécanismes rhétoriques qui les fondent et sur les grandes logiques (d’opposition à des figures spécifiques ou à des institutions) qui les motivent, en cherchant à mettre en lumière la façon dont cette omniprésence de la dérision est directement provoquée par l’état du champ littéraire de l’époque. This paper proposes to reconstruct the means of acquisition and transmission of anatomical and surgical knowledge in the period from the death of Alexander the Great (323 BC) to the reign of Constantine VII Porphyrogenitus (913-959), through the study of archaeological, epigraphic, papyrological and manuscript sources. These testimonies bring to view strategies such as observation, experimentation, analogy and imitation, as well as oral and written teaching, redaction and copy of books (illustrated or not), elaboration of commentaries, abridgments, questionnaires and word-lists. A distinction will be drawn between texts which were addressed to physicians and medical students, on the one hand, those which were destined to philiatroi and to an educated readership, and finally those which might interest copyists and eventually tachygraphists. Bernard Bolzano notoriously rejected Immanuel Kant’s claim that arithmetic and geometry were grounded on synthetic a priori judgements based on pure intuition. According to Bolzano, only analysis of concepts could ground the generality of mathematical statements and proofs; such a stand would later lead to logicism (from Frege to Carnap). Far from going in this way, however, Charles Sanders Peirce, who was one of the fathers of formal logic but also a great admirer of Kant, provided semiotic reasons to believe that diagrams do have a general meaning and that they can provide a knowledge which is both general and “ampliative”. Unlike mere logical analysis, diagrams (the analogon of Kant’s schemas) help to explore concepts by going somehow “outside of them” in such a way that new knowledge is gained. This provides new support to Kant’s notion of intuitive construction, which is supposed to be both deductive and inventive [less ▲]

By the way these pathways are tightly interwoven, with the consequence that a deregulation at the level of any of these molecular mediators can affect the others.MiRNAs are demonstrated to be deregulated in inflammatory bowel diseases and in colorectal cancer. Moreover, they target several molecular mediators that connect inflammation to cancer, and they are thus implicated in the route from inflammation to colorectal cancer.This chapter will focus on the miRNAs that are jointly deregulated in inflammatory bowel disease and in colorectal cancer. In this paper, we offer a new interpretation for O. Cairo JdE 72460. Based on a discussion of the expressions used for measuring distances in the New Kingdom documentation, we explore the various possible translations. We then try to map the abstract relationships between places as well as the related measurements onto actual archeological structures. À partir de 1948, où il donne des préfaces à l’Anthologie de la nouvelle poésie nègre et malgache et à l’antiroman de Nathalie Sarraute, Portrait d’un inconnu, jusqu’au début des années 1970, Sartre a écrit une quinzaine de préfaces. Dans plusieurs cas, ces préfaces sont comme indissociables de l’ouvrage préfacé ; on leur reproche souvent d’avoir pris le dessus sur celui-ci. Il s’agit ici de relire la préface de Sartre aux Damnés de la terre de Frantz Fanon. Cette préface, peut-être la plus célèbre, sûrement la plus scandaleuse, est souvent réduite à l’invitation à la violence libératrice qu’on y trouve ou croit y trouver, sans qu’il ne semble guère utile de relire le texte de Sartre, une fois pour toutes saisi dans une posture d’aveu. En partant de l’unique rencontre de Fanon et de Sartre à Rome, à l’été 1961, il s’agit, plus précisément, de comprendre la « collaboration » qui se noue alors entre les deux hommes : à savoir de comprendre de quelles façons Sartre construit sa préface en prenant sur lui une certaine histoire de la littérature noire (Maran, Wright, Fanon) qui lui permet, à partir de cette rencontre à la mort, de (presque) confondre sa situation avec celle de Fanon. Dans ce texte-bilan d’une décennie d’engagement jusqu’à l’épuisement, Sartre trouve en même temps la possibilité de réécrire « Orphée noir », à partir des romans contemporains de Boris Vian et de Richard Wright, et de réécrire Fanon lui-même en l’envisageant au futur à partir de Peau noire, masques blancs. La littérature sartrien apparaît du coup non pas comme un abandon complaisant à la violence, mais comme une manière de regarder la réalité en face, ce que Qu’est-ce que la littérature ? désignait comme un art de (se) faire honte. This Chapter aims at delineating a proper ethical and legal response to the ‘dual-use dilemma’ of nuclear science and technologies. After assessing the different models of governance proposed so far for addressing the ‘dual-use’ feature of nuclear technologies, and based on precautionary, proactionary and cost/benefit approaches, it develops a framework based on the notion of ‘responsible stewardship’. This framework is based on a comprehensive analysis – through the involvement and cooperation, as much as possible, of all the stakeholders in the field – of both the advantages and the risks of the nuclear area, considering social, ethical, legal, environmental and political values. The policies then adopted are periodically and constantly revised (according to a ‘step by step’ principle) and based on the proportional balance of interests, values and rights at stake. A multilevel framework of sources and actors is involved in such a responsible process. A specific attention is devoted to the balance between the freedom to research and the security needs at the individual and at the State level, in particular focusing on Article IV of the Treaty of Non-Proliferation of Nuclear Weapons. Concrete ways for applying such model are explained, in particular with regard to the control of materials, education of people, and control of information. Finally, the historical steps in the governance of nuclear technologies are explored and some examples provided for the suggested approach. [less ▲]

The video industry in Nigeria has developed within a widely informal economic environment in which the illicit reproduction and circulation of goods were the rule rather than the exception. The informality of circulation has played a particularly influential role in both the history of the video industry and the genesis of the present crisis. While, on the one hand, it has made videos available all over the African continent and within the diaspora, creating the basis for Nollywood’s international success, it has, on the other hand, weakened the industry’s economy, exposing it to consecutive cycles of saturation and collapse. For this reason, the production crisis that emerged over the past few years has catalyzed numerous controversies concerning the structure of the video economy and the rules that regulate it. The informality on which the video economy has been based since its inception is today often considered a threat to the survival of the industry itself. While the industry has achieved global recognition, the economic fragility of its success has provoked growing anxiety. This anxiety has been progressively concentrated, by both media and video entrepreneurs, on issues of piracy and copyright protection. The aim of this chapter is to investigate the causes of this anxiety and the role that piracy and transformations in copyright legislation have had in catalysing it, while shaping the economy of the industry. Throughout this chapter I will argue that when the uncontrolled circulation of goods begins to undermine the economic basis of the industry that produces them, the rhetoric of piracy is mobilized to ensure the accessibility to the economy of both the production and the distribution of the goods themselves. This allows some of the entrepreneurs involved in the production process to gain exclusive control over it and the capital it generates. Within the Nigerian context, the rhetorical construction of piracy and the legal and economic consequences of this construction are the result of specific conflicts among different segments of the Nigerian video industry and, more precisely, different models of economic entrepreneurship. As the history of the Nigerian video phenomenon shows, a loose copyright regime seems to have positive consequences for the emergence and early development of a creative industry, although, once the industry seeks to attain higher levels of profitability, it tends to become problematic, and the rhetoric of piracy can become a tool to orient processes of restructuration of the cultural industry’s economy. In relation to this dynamic, I analyse the way in which the normative orders that regulate the reproduction and circulation of images and contents developed within the Nigerian context, and I discuss how their introduction and implementation progressively shaped people’s perception of legal and illegal practices in the field of local cultural production. This paper discusses the toponymy of Ancient Egypt, by considering its specificities in respect of the history of toponomastic sciences since Classical Antiquity from a historiographical point of view, and by dealing with the toponymic material itself. After an introductory part on the history of toponymics in Egyptology, this article intends to give a general sketch of Ancient Egyptian toponyms and their forms by addressing questions such as how toponyms were constructed, or to which part of a territory they were applied and by whom. The analysis of the toponymic stratification of Egypt then gives the opportunity to list sources and research tools that are at the disposal of Egyptologists working on toponymic matters. This article also aim at putting forward the methodological elements that one should take into account in studies of Ancient Egyptian toponymics and provides a selective bibliography in conclusion.
