In the case Grosaru v. Romania, the European Court of Human Rights ruled that the verification-mechanism of powers of elected representatives by the Romanian Parliament lacked impartiality and violated Article 3 of Protocol No 1. Regarding the issue of the possible generalisation of this conclusion to other States which experience a similar system, the high jurisdiction sends a blurred message: it affirms that some States benefit from a long democratic tradition which would seem to dispel doubts on the legitimacy of such a practice. This study aims to analyse – in a general perspective – the role acknowledged by the Court to the historical and political context in its electoral case-law. The precise scope of the Grosaru ruling will therefore be enhanced. [less ▲]
